Terms of Use

These terms govern access to and use of the WixoSolutions online platform and related services (the "Service"). By registering for or using the Service, you accept these terms in full. If you do not agree, please do not use the Service.

1. Description of the Service

The Service provides management software for food service businesses (e.g. menu, orders and features described on the website). Functionality may evolve over time. The software is provided "as is"; use is at your own responsibility within the framework of applicable law.

2. Account and security

You are responsible for the accuracy of your registration details, the confidentiality of your credentials and all activity under your account. You must notify us promptly of any unauthorised use.

3. Data and compliance

As the operator of a business using the Service, you are responsible for accurate entry of customer/order data where applicable, and for compliance with data protection law (including the GDPR), tax law and commercial regulations. Our processing of data as processor/support provider is described in our Privacy Policy.

3.1 Processing on behalf of the customer (B2B)

When you register as a food service business and use the Service, you act as data controller for personal data collected through the Service (e.g. orders from digital menu/QR, customer details where recorded, restaurant staff). WixoSolutions acts as data processor on your behalf, solely to provide, operate, support and secure the Service, in accordance with your instructions and these terms.

We process on your behalf, for example: order data (items, quantities, table, timestamp, status), technical data necessary for operation (e.g. logs, system identifiers) and user account data you manage (staff). We do not use this data for our own independent marketing to your customers unless explicitly agreed or required by law.

You must inform your customers/visitors (e.g. via notices on the menu or at your premises) about data processing, respond to data subject requests where you are controller, and provide us with lawful instructions for use of the Service. We will provide reasonable technical support for requests directed to us as processor.

Processing is carried out through sub-processors (e.g. hosting, database/identity) bound by contract. Details are in our Privacy Policy. By accepting these terms and using the Service, you accept this processor relationship to the extent permitted by applicable law.

4. Acceptable use

You must not use the Service to:

• pursue unlawful purposes or infringe third-party rights;
• distribute malware, overload systems or attempt unauthorised access;
• disrupt the security or operation of the Service.

We reserve the right to restrict or terminate accounts in case of breach of these terms.

5. Intellectual property

Service elements (software, design, website text except content you upload) are protected. No licence is granted beyond what is necessary to use the Service under these terms.

6. Availability and disclaimer of warranties

We strive for availability and reliability. We do not guarantee uninterrupted or error-free operation. The Service is provided without express or implied warranties to the maximum extent permitted by applicable law.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits or data loss arising from use of the Service, except where mandatory law provides otherwise.

8. Amendments

We may update these terms. Material changes will be announced reasonably (e.g. via the Service or website). Continued use after an update constitutes acceptance unless stated otherwise.

9. Governing law

These terms are governed by the laws of the Hellenic Republic and EU law where applicable. The courts of Athens have jurisdiction, unless mandatory consumer law provides otherwise.
